English summary: This standard textbook analyses environmental problems and environmental policy from an economic point of view, providing not only a comprehensible presentation of environmental economics & from its microeconomic foundations to the latest research approaches & but also guidance for current environmental policy discussions. Extensive updates have been made for the new edition, particularly in relation to the Paris international climate protection agreement and EU emissions trading. The approach based on the economics of environmental policy instruments is expanded with the inclusion of considerations of behavioural economics. Das k}rzlich verabschiedete Umwelthaftungsgesetz wirft eine Vielzahl von umweltrechtlichen und umwelt|konomischen Fragen auf, z. B. bez}glich der - rechts- und umweltpolitischen Zielsetzung des Umwelthaftungsgesetzes, - der Wirksamkeit des Umwelthaftungsgesetzesals Anreiz zur Schadensverh}tung, - der Anreizkompatibilit{t der obligatorischen Umwelthaftpflicht-Versicherung, - der Grenzen der Versicherbarkeit von Umweltrisiken, - der Besonderheiten im Falle des Mitverschuldens des Gesch{digten und bei Summations- und Distanzsch{den, - der M|glichkeiten von Fondsl|sungen, Umweltgenossenschaften oder anderen kollektiven Schadenstragungssystemen und - der Rolle des Haftungsrechts im Kanon umweltpolitischer Instrumente. Das vorliegende Buch beleuchtet diese Fragen in einem interdisziplin{ren Dialog von Juristen und \konomen, der im Rahmen des Kollegs "Umweltstaat" der Gottlieb Daimler- und Carl Benz-Stiftung in den Jahren 1989 bis 1991 stattgefunden hat. Es bietet einenumfassenden ]berblick }ber die Probleme und Perspektiven des Haftungsrechts als Instrument des "Umweltstaats".

In den letzten Jahren sind Fragen des Haftungsrechts in Wissenschaft und Politik intensiv diskutiert worden. Produkthaftung, Arzthaftung, Arbeitnehmerhaftung, Umwelthaf- tung und Haftung bei Verkehrsunfallen waren dabei die wichtigsten Anwendungsgebiete, Gefahrdungshaftung und Verschuldenshaftung die meistzitierten Formen des Haftungsrechts. Wahrend in der juristischen Diskussion der Aspekt des "gerechten, Schadensausgleiches" im Vordergrund stand, haben sich die Okonomen insbesondere fur die Praventionswirkungen des Haftungs- rechts interessiert. Hierbei geht es urn die Frage, inwieweit haftungs- rechtliche Regelungen geeignet sind, die potentiell an einem Unfall Beteiligten ("Verletzer" und "Opfer") zu sorgfaltigem Handeln zu veranlassen. Die Sorgfalt ist dabei das Mittel, mit dem die Unfallwahrscheinlichkeit und gegebenenfalls auch das AusmaB des entstehenden Schadens vermindert werden konnen. Die Okonomen waren keine Okonomen, wenn sie das hiermit ange- sprochene Problem nicht auf die Frage zuspitzten, worin denn ein optimales Sorgfaltsniveau bestehe, und inwieweit es uber das Haftungsrecht realisierbar seL Das vorliegende Buch stellt die okonomische Sicht des Haftungsrechts auf folgende Weise dar: Zunachst wird in einem einleitenden Teil (A) begriindet, warum sich Okonomen mit Fragen des Haftungsrechts beschaftigen und auf wel- che Weise sie zu ihren Aussagen gelangen. Die Darstellung knupft stark an die in der angelsachsischen Literatur unter der Bezeichnung Vonoort VIII "Law & Economics" von Posner, Shavell und anderen begriindete Richtung an. Fur Angehorige des "Tribe of the Econ"l mag diese Vorgehensweise selbstverstandlich sein. Da dieses Buch jedoch uber die Stammesgrenzen hinaus wirken will, ist eine solche Grundlegung unverzichtbar.

Liegen externe Effekte vor, so weichen private und soziale Kosten und Ertrage voneinander ab. Der Marktmechanismus bringt dann auch bei vollkommener Konkurrenz keine pareto-optimalen Gleichgewichtszustande hervor.
