1994 hat das Institut fur Rechtsvereinheitlichung UNIDROIT ein neues Regelungswerk herausgebracht, die "Principles of international commercial contracts". Die "Grundsatze" bestehen aus vielen allgemeinen und einigen detaillierten Regelungen. Damit die UNIDROIT-Principles trotz auftretender Lucken ihr Ziel, Handelsvertrage moeglichst umfassend zu regeln, erreichen koennen, wurde eine Regelung zur Luckenerganzung aufgenommen. Im ersten Teil dieser Arbeit wird darauf eingegangen, wann eine Lucke anzunehmen ist, was als allgemeiner Grundsatz angewendet werden kann, welche Methoden der Grundsatzherleitung fur die UNIDROIT-Principles sinnvoll sind und welche Kriterien an die grundsatzliche Bestimmung einer externen, nicht durch Art. 1.6 II erganzbaren Lucke angelegt werden koennen. Im zweiten Teil werden die theoretischen Grundlagen des ersten Teils am Beispiel der Ruckgewahrschuldverhaltnisse, postvertraglichen Pflichten und objektiven Beweislast dargestellt.
