Der Geltungsbeginn der europaischen Datenschutzgrundverordnung im Mai 2018 steht kurz bevor. Der Autor beschaftigt sich mit den Auswirkungen der DSGVO auf die Anwendbarkeit des deutschen Kunsturhebergesetzes und seiner Regelung des Rechts am eigenen Bild. Er analysiert, wann der Umgang mit Personenbildern datenschutzrechtliche Relevanz hat, wie weit der Anwendungsvorrang der DSGVO als gemeinschaftsrechtlicher Regelung dabei reicht und wo sie noch Spielraume hinterlasst, in denen eine Fortgeltung des KUG erreicht werden kann. Hier sind beispielhaft das "Medienprivileg" und die Verarbeitung im Beschaftigungskontext zu nennen. Dies erfordert jedoch mitunter, dass der nationale Gesetzgeber bald aktiv wird, um von OEffnungsklauseln der DSGVO Gebrauch zu machen.
