The Law of War and Peace: Volume Two offers a cutting-edge analysis of the relationship between law, armed conflict, gender and peace. This second volume focuses on peace and the law after war and during the post-conflict period, examining the post-conflict legal structures that regulate peacekeeping, peacebuilding, and peace agreements. It also offers a gender analysis of environmental security and explores food security and transitional justice. Across the book the authors examine the laws that are situated and developed to promote the shift from armed conflict to peace, as well as the role of militarism and military masculinities in the production of ‘the everyday’ of so-called peacetime states. They reflect on the possibility for feminist change in the law on war and peace, as understood through a gender analysis, and encourage dialogue beyond the confines of these pages, in a slow and considered commitment to queer feminist peace.

In the past decade, a sense of feminist 'success' has developed within the United Nations and international law, recognized in the Security Council resolution 1325 on women, peace and security, the increased jurisprudence on gender based crimes in armed conflict from the ICTR/Y and the ICC, the creation of UN Women, and Security Council sanctions against perpetrators of sexual violence in armed conflict. Contributing to the development of feminist and gender scholarship on international law, Gina Heathcote provides a feminist analysis of the central pillars of international law, noting the advances and limitations of feminist approaches. Through incorporating into mainstream international legal studies specific critical and feminist narratives, this book considers the manner in which feminist thinking has changed international law, and the manner in which international law has remained impervious to key feminist dialogues. It argues for a return to structural bias feminism that engages the foundations of international law and uses gender as a method for challenging post-millennium narratives on fragmentation, the role of international institutions, the nature of legal authority, sovereignty, and the role of international legal experts.

The book highlights key conceptual barriers to the enhanced application of the law of the use of force, and develops international feminist method through rigorous engagement with the key writers in the fieldThe book looks at the key aspects of the UN Charter relevant to the use of force – Article 2(4), Article 51 and Chapter VII powers – as well as engaging with contemporary debates on the possibility of justified force to meet self-determination or humanitarian goals. The text also discusses the arguments in favour of the use of pre-emptive force and reflects on the role feminist legal theories can play in exposing the inconsistencies of contemporary arguments for justified force under the banner of the war on terror. Throughout the text state practice and institutional documentation are analysed, alongside key instances of the use of force. The book makes a genuine, urgently needed contribution to a central area of international law, demonstrating the capacity of feminist legal theories to enlarge our understanding of key international legal dilemmas.
