Ziel der Arbeit ist die vollstandige rechtliche Darstellung und Wurdigung der Komponenten des haftenden Eigenkapitals und der Drittrangmittel der Kreditinstitute. Daruber hinaus werden Vorschlage fur eine Erweiterung der Eigenmittelbasis vorgestellt. Ausgehend von den Zielen des Kreditwesengesetzes werden die Anforderungen der Bankenaufsicht an die Eigenmittel dargestellt und einer eingehenden Analyse unterzogen. Daran anschliessend werden zunachst die rechtsformspezifischen und sodann die rechtsformunabhangigen Eigenmittelkomponenten in ihrer rechtlichen Ausgestaltung eroertert, um sie dann einer systematischen und ausfuhrlichen Prufung hinsichtlich den Anforderungen der Bankenaufsicht zu unterziehen. Dabei ergeben sich eine Reihe von Moeglichkeiten, die Eigenmittel durch nicht im Gesetz genannte Kapitalelemente zu verbessern, wie z. B. durch partiarische Darlehen oder "harte" Patronatserklarungen. Ausserdem werden detailliert begrundete Vorschlage fur eine Einbeziehung von nicht eingezahltem kapital prasentiert.
