This book explores the unique nature of the fluidity of law in the continual evolution of society and the development of laws to respond to new life situations. While the fluidity of law frequently fluctuates from one moment to the next, this flexibility enables law to meet and adapt to new standards. Rather, law as a living entity is under constant strain and needs to be firmly grounded in the past as it subsequently adjusts or even swings in new directions to accommodate new possibilities. Its theoretical perspectives, including philosophical and sociological theories, are necessarily situated in relation to this tension-filled system. This book first explores the socio-cultural and legal portrayals of the fluidity of law, then provides legal case studies of this tension-filled system on localized as well as comparative scales. More generally, the book explores legal, social, and cultural avenues to help this system claims its unique identity; i.e., the fluidity of law.

This book brings together academics and practitioners from a range of disciplines from more than twenty countries to reflect on the growing importance of transparency, power and control in our international community and how these concerns and ideas have been examined, used and interpreted in a range of national and international contexts. Contributors explore these issues from a range of overlapping concerns and perspectives, such as semiotic, sociolinguistic, psychological, philosophical, and visual in diverse socio-political, administrative, institutional, as well as legal contexts. The collection examines the ways in which 'actors' in our society - legislators, politicians, activists, and artists - have provoked public discourses to confront these issues.

Die Arbeit befasst sich neben den gerichtlichen Rechtsschutzmoeglichkeiten insbesondere mit den Verfahrensrechten von Wettbewerbern im Beihilfenrecht. Untersucht werden das Beschwerderecht des Wettbewerbers, seine Verteidigungsrechte und die Pflichten der Kommission gegenuber dem Wettbewerber vor Genehmigung einer Beihilfe. Kritisch beleuchtet wird auch die 1999 in Kraft getretene Verfahrensverordnung fur das Beihilfenrecht. Diese genugt nach Ansicht der Verfasserin nicht den von der Rechtsprechung aufgestellten Anforderungen an die Verteidigungsrechte von Wettbewerbern. Mit Blick auf die Frage der Rechtssicherheit wird sodann der Gebrauch von "soft law" im Beihilfenrecht problematisiert. Schliesslich werden verschiedene Ansatze zur Verbesserung der Stellung des Wettbewerbers diskutiert.
