International law is constantly adapting in response to developments in State practice, new treaties and an expanding international jurisprudence. International Law: Cases and Materials with Australian Perspectives provides students with up-to-date coverage of changing laws and their practical applications through a uniquely Australian lens. The fourth edition re-examines the principles and application of international law following major world events including the COVID-19 pandemic, Russia's invasion of Ukraine and the ongoing Israel–Palestine conflict. The student-friendly text has been thoroughly updated to reflect landmark cases and developments in the law resulting from these events, as well as the ongoing challenges of climate change, crimes against humanity, genocide, human rights abuses, nuclear proliferation, resource management, self-determination of peoples, and new treaties dealing with the high seas. Each chapter includes suggested further readings to encourage independent study. Written by an expert author team, International Law remains an essential resource for Australian law students.

Islands and their status in international law have become one of the more contentious issues in public international law. However, despite this, there is no contemporary book-length study on the question. This book fills that gap. Written by one of the world’s leading public international lawyers, it offers an authoritative overview of how public international law operates in relation to islands. Key issues such as artificial islands, archipelagos, sovereignty, territorial rights, maritime entitlements, and governance are explored in depth. This will become a classic text in the field of international law.

Praise for the previous edition: “A complete overview of the subject which does not intimidate the reader but rather spurns interest and understanding in the subject.” European Energy and Environmental Law Review “…(the book is) scholarly yet accessible and very readable; thoroughly recommended.” Law Institute JournalDescriptionThe law of the sea provides for the regulation, management and governance of the ocean spaces that cover over two-thirds of the Earth’s surface. This book provides a comprehensive assessment of the foundational principles of the law of the sea, a critical overview of the 1982 United Nations Convention on the Law of the Sea and an analysis of subsequent developments including many bilateral, regional, and global agreements that supplement the Convention. The third edition of this acclaimed text has been thoroughly revised and updated, and now incorporates a dedicated chapter on natural and artificial islands. All of the main areas of the law of the sea are addressed including the foundations and sources of the law, the nature and extent of the maritime zones, the delimitation of overlapping maritime boundaries, the place of archipelagic and other special states in the law of the sea, navigational rights and freedoms, military activities at sea, marine scientific research, and marine resource and conservation issues such as fisheries, marine environmental protection and dispute settlement. The book also takes stock of contemporary oceans governance issues not adequately addressed by the Convention. Overarching challenges facing the law of the sea are considered, including how new maritime security initiatives can be reconciled with traditional navigational rights and freedoms, the need for stronger legal and policy responses to protect the global ocean environment from climate change and ocean acidification, and work on a new agreement for the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction.

The Association of Southeast Asian Nations (ASEAN) has achieved deeper regional market integration to lay a socio-economic foundation for the development of a regional community, yet inter-state trust is by no means assured as Southeast Asian nations remain steadfast in maintaining their political regime stability against external interference. However, through its institutional practices, ASEAN has emerged as a distinct model of security institution, while the region's contemporary security landscape has diversified with various non-traditional security issues. By looking beyond the veneer of diplomacy and prevailing political circumstances, this book examines the legal nature and form of ASEAN's authority to address diverse regional security issues. It provides a fresh perspective on ASEAN's role as a security institution. With an interdisciplinary analysis, this book reveals the normative role that ASEAN plays in facilitating the processes of norm development, localisation and internalisation as it deals with contemporary security challenges confronting Southeast Asia.

In Arctic Ocean Shipping, Donald R. Rothwell assesses contemporary navigation, security and sovereignty issues in the North American Arctic. Shipping in the Arctic Ocean is becoming a critical legal, geopolitical and security issue as a result of climate change and increased interest from non-Arctic States such as China. The law of the sea provides the key legal framework for the regulation of Arctic Ocean shipping, and has been relied upon by Canada and the United States to develop the legal regime for the Northwest Passage and the Bering Strait. Navigation within the EEZ and high seas in the Arctic is also becoming more strategically significant as a result of climate change. Multiple issues are raised with respect to maritime security and the adequacy of the existing legal regime, including how Canada and the United States will respond to interest being expressed in Arctic shipping by Asian States.

The purpose of this book is to assess the development of international environmental law in the Asia Pacific. Consideration is given to the impact upon the region of global, regional and subregional environmental law. An assessment is undertaken of how certain states, and groups of states, have responded domestically and within their own subregions to these developments. The Asia Pacific is defined as essentially the states which comprise East and Southeast Asia, Australia, New Zealand and the island states of the Southwest Pacific. Occasional consideration is also given to the states of South and Central Asia. The book commences with an overview of international environmental law, the role of international organizations, and the development of regional environmental law. Consideration is then given to a number of prominent sectoral areas including heritage, biodiversity, marine environment, climate change, and the relationship between trade and the environment. A study is then undertaken of the influence of international environmental law in a number of states and subregions within the Asia Pacific.

This book deals with international law in Antarctica and the Arctic. It reviews how each region is managed by the individual legal regimes, and how the special international laws developed specifically to deal with polar problems (for instance, protection of the environment) have contributed to the development of international law. It covers the legal issues concerning the geography and environment of the regions; the relevant aspects of the law of the sea; resource management; and environmental protection. The author reviews the international relations regime theory to analyse the development of the Polar regimes, and considers how the international relations necessary to deal with the unique problems caused by the polar environment and regional politics, has contributed to a greater understanding of international law.
